In the wake of the Supreme Court’s landmark ruling Monday legalizing same-sex marriage nationwide, some conservatives are urging the justices to throw out the law that legalized it in all 50 states.
But the president signed the federal Defense of Marriage Act into law as part of the national defense authorization bill, which also included a provision protecting states who decide to not recognize same-sex marriages out of federal money because of religious objections. In a statement Monday afternoon, the Justice Department said, “As one who opposed DOMA for more than a year, I’m saddened to see it go.”
While many prominent conservatives have gone on the record opposing same-sex marriage and have opposed the DOMA provision, that doesn’t mean that many conservative activists are willing to do anything to stop the decision.
When Rep. Tim Huelskamp (R-Kan.), one of the most conservative members of the House, announced his retirement in January, many conservatives celebrated.
On Wednesday, however, many of these same conservatives began rallying around the defense of the Defense of Marriage Act. Rep. “The idea that the Senate is going to do anything aboutDOMA is just plain wrong,” he said. “If the Congress were to pass legislation to defend DOMA, I would sign it — because I believe this is a law that discriminates and must be repealed.”
One conservative activist who has been vocal against same-sex marriage is former Arkansas Gov. Mike Huckabee. He’s urging the Supreme Court to overturn DOMA because it bans federal recognition of same-sex marriages.
