The question is whether the individual targeted by the “hateful act” is willing to endure the physical or psychological damage caused by the threats. What if a spouse comes into court and tells the judge the same thing that the person targeted by the “hateful act” told you privately? This is another hard one to prove. So what then? Is it reasonable to think that a target who is threatened with physical death or serious harm is willing to endure that
